RE: JEWEL/OSCO - ARCHER AND AUSTIN, CHICAGO

Dear Ms. Botthof:

I have been in receipt of your letter of July 28, 2002 and wanted to clarify a few points with you. In reference to our meeting, I had stated in my letter of July 23`d that I could not meet with you until the 4"' week of August. This was due to my heavy travel schedule and not because of my boss being on vacation. We will not be waiting for my boss to meet with us since he is located in the corporate office in Boise, Idaho.

In your second paragraph, you stated that the company broke the Accessibility Law by not making the handicap spaces 16' across and you stated that they must be 8' x 8'. I have had the Architect of Record make a field visit and verified that the spaces are in fact 16' across. I have attached two detailed drawings that show how the spaces were designed and constructed. These details are approved details for the City of Chicago. I have also made contact with the Mayor's office regarding disabled persons and have arranged for a meeting with them to review the site.

Since my travels and workload seem to be making it difficult to meet, I have made arrangements with one of the Construction Managers that works for me to meet you at the site. His name is Randy Kriegel and he will be contacting you very soon. Please work with Randy on any matters relating to this issue. For your reference, Randy's office number is 708/492-3042.

Thank you for your comments that you have shared with me and I look forward to a successful meeting to resolve this matter.

Sincerely,

JEWEL/OSCO
